Porsche Faces Class Action Lawsuit Over Taycan Battery Defect

A significant class action lawsuit has been filed against Porsche following its recent recall of 2020-2024 Taycan models across the United States due to a battery defect. The lawsuit, initiated by Gibbs Law Group, represents owners and lessees of affected vehicles and seeks both punitive and compensatory damages.

Allegations of Safety Risks and Negligence

The lawsuit, led by plaintiff Miodrag Kukrika, alleges that Porsche has failed to adequately address or disclose a “dangerous and widespread” defect in the Taycan’s high-voltage battery pack. According to the filing, Porsche was aware of the issue as early as February 2020, following a vehicle fire in a Florida residence.

“Porsche investigated the incident and has since received multiple reports of fires and owner complaints linked to the battery defect,”

States the class action.

The high-voltage battery issue, described as having the potential to short-circuit and cause fires, prompted Porsche to issue a recall in October 2024. The automaker advised owners to limit charging to 80% capacity until a diagnostic system could be introduced in early 2025. This system is designed to detect anomalies in battery modules, with faulty batteries to be replaced where necessary.

Plaintiff’s Claims Against Porsche

The lawsuit accuses Porsche of:

  • Fraudulent concealment and omission of the defect.
  • Breach of the implied warranty of merchantability, claiming the cars were sold in a condition unfit for safe use.
  • Negligent misrepresentation and omission, alleging Porsche failed to communicate the defect’s full risks effectively.

The legal action seeks a jury trial and calls for:

  1. Injunctive relief to mandate immediate repairs or replacements for defective batteries.
  2. An award of punitive, compensatory, treble, and exemplary damages for affected class members.

“The Battery Defect poses a significant safety risk not only to drivers and passengers but also to homes and structures where these vehicles are parked,”
